OVERVIEW

The terms "we", "us" and "our" refer to Purdice Jewellery, which operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Purdice Jewellery is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services you agree to be bound by these Terms and our Privacy Policy https://purdicejewellery.co.uk/policies/privacy-policy. If you do not agree, you should not use the Services. 

 

SECTION 1 — ACCESS AND ACCOUNT

By agreeing to these Terms you confirm that you are at least the age of majority (18+) where you live, and that you consent to any minor dependants using the Services on devices you own or manage. To use the Services you may be asked to provide information such as your email address and billing, payment and shipping details. You confirm that everything you provide is correct, current and complete, and that you have the right to provide it. You are responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell or assign your account to anyone else.

 

SECTION 2 — OUR PRODUCTS

We make every effort to represent our products accurately. Colours and appearance may differ depending on your screen and device settings. We do not warrant that the appearance or quality of any product will match your expectations exactly. Product descriptions may change at any time without notice. We may discontinue any product and may limit quantities offered to any person, region or jurisdiction.

 

SECTION 3 — ORDERS

When you place an order on our website, you are making an offer to buy. We accept your order, and a contract is formed, when we send you an order confirmation by email. Until then we may decline your order at our discretion. If we decline it and you have already paid, we will refund you in full without undue delay.

You have the right to cancel your order within 14 days without giving any reason. The cancellation period starts when you place your order and ends 14 days after the day you (or a person you nominate) receive the products. If your order is delivered in several parts, it ends 14 days after you receive the last part. To cancel, tell us clearly by email at info@purdicejewellery.co.uk. You must send the products back to us within 14 days of telling us you wish to cancel. The right to cancel does not apply to products made to your specifications or clearly personalised, or to sealed products that are not suitable for return for hygiene reasons and have been unsealed after delivery. We will tell you before you buy if a product is excluded.

We may cancel an order before we dispatch it, for example if a product is unavailable, if there is an error in the price or description (see Section 11), if we cannot process your payment, or if we reasonably suspect fraud. We will tell you and give you a full refund of everything you have paid, without undue delay and within 14 days.

 

SECTION 4 — PRICES, VAT AND BILLING

All prices are shown in pounds sterling (GBP) and include UK VAT. The price you pay is the price shown at checkout and in your order confirmation when you place your order. Delivery charges, if any, are shown separately before you pay.

We may change prices, discounts and promotions at any time, but a change will not affect an order that we have already confirmed. If we discover a pricing error, Section 11 applies.

Orders with a total value of £135 or less. Our products are shipped to the UK from outside the UK. For orders where the total value of the goods in the shipment is £135 or less, we charge UK VAT at checkout and it is included in the price you pay. [No customs duty is currently payable on these orders.] You will not be asked to pay any further taxes or charges when your order is delivered. If UK rules change and customs duty becomes payable on these orders, we will tell you before you place your order.

Orders with a total value above £135.

For orders where the total value of the goods in the shipment is more than £135, UK import VAT and any customs duty are payable when the goods enter the UK. We pay these on your behalf and they are included in the price shown at checkout. You will not be asked to pay anything further on delivery.

The £135 threshold applies to the total value of the goods in a single shipment, not to individual items, as determined under UK customs rules.

By placing an order you confirm that the payment details you give us are correct. 

SECTION 5 — SHIPPING AND DELIVERY

Our products are shipped to you directly from our supplier in China. Delivery can take up to 15 working days from the date we confirm your order. We will give you an estimated delivery date or timeframe at checkout and in your order confirmation. Delivery is complete when you, or a person you have nominated, take physical possession of the products. The products remain at our risk until then. If your order is lost or damaged in transit, please contact us as soon as possible at info@purdicejewellery.co.uk.

 

SECTION 6 — INTELLECTUAL PROPERTY

The Services, including all trademarks, text, images, graphics, video, audio and the design and arrangement of the site, are owned by Purdice Jewellery or its licensors and are protected by intellectual property law. These Terms allow you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, republish or transmit any material from the Services without our written consent. All rights not expressly granted are reserved.

 

SECTION 7 — THIRD-PARTY TOOLS AND LINKS

The Services may give you access to websites and tools provided by third parties, which we neither monitor nor control. These are provided "as is" without warranties of any kind. Use of them is at your own risk, and you should review the relevant third party's terms and policies. We are not liable for any loss related to third-party websites or tools.

 

SECTION 8 — RELATIONSHIP WITH SHOPIFY 

Purdice Jewellery is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Purdice Jewellery. By using the Services you acknowledge that Shopify is not responsible for any aspect of any sale between you and Purdice Jewellery.

 

SECTION 9 — PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy https://purdicejewellery.co.uk/policies/privacy-policy, and certain personal information may also be subject to Shopify's privacy policy. Because the Services are hosted by Shopify, information you submit is transmitted to and shared with Shopify and with third parties that may be located in other countries, in order to provide the Services to you. 

 

SECTION 10 — FEEDBACK

If you submit ideas, suggestions, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display it for any purpose, including commercial use. You confirm that you own the rights to your Feedback, that you have disclosed any compensation received in connection with it, and that it does not infringe any third-party rights or contain unlawful, abusive or obscene material. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it, and we may remove Feedback we consider objectionable.

 

SECTION 11 — ERRORS AND OMISSIONS

Information in the Services may occasionally contain typographical errors, inaccuracies or omissions relating to descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct errors and update information, and may cancel orders based on inaccurate information, at any time and without prior notice, including after you have placed your order but before shipping.

 

SECTION 12 — PROHIBITED USES

You may use the Services for lawful purposes only. You may not use them for any unlawful or malicious purpose, to violate any law, to infringe intellectual property rights, to harass or harm any person, to transmit false or misleading information, to send spam or unsolicited advertising, to impersonate any person or entity, or to interfere with anyone else's use of the Services. You also agree not to upload malicious code, resell or exploit any part of the Services, collect other people's personal information, scrape or crawl the site, or circumvent its security features. We may suspend or terminate your access at any time if we determine you have breached these Terms.

 

SECTION 13 — TERMINATION

We may terminate this agreement or your access to the Services at any time at our discretion, and you remain liable for all amounts due up to the date of termination. Termination of access should not affect accepted orders. Sections on intellectual property, feedback, disclaimers, liability, indemnification, governing law and privacy survive termination.

 

SECTION 14 — DISCLAIMER OF WARRANTIES

The products we supply to you will be of satisfactory quality, fit for their intended purpose, and as described, as required by the Consumer Rights Act 2015. Nothing in these Terms affects those rights. If a product is faulty or not as described, please contact us and see our Return & Refund Policy https://purdicejewellery.co.uk/policies/refund-policy, for how to request a replacement or refund.

We take care to describe and photograph our products accurately. Please note that colours may appear slightly different depending on your screen and device settings.

Other information on the Services, such as styling suggestions, care tips or blog content, is provided for general information only. We do not guarantee that it is complete or suitable for your particular circumstances. This does not limit our responsibility for the accuracy of product descriptions, prices, delivery information and any other information we are legally required to give you.

We will take reasonable steps to keep the Services available and secure, but we do not guarantee that they will be uninterrupted or error-free. This does not affect your right to receive products that conform to your contract with us.

 

SECTION 15 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, we and our directors, employees, affiliates, agents, contractors and service providers are not liable for any indirect, incidental, punitive, special or consequential damages, including lost profits, lost revenue or loss of data, arising from your use of the Services or any product purchased through them. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for your statutory consumer rights.

 

SECTION 16 — YOUR CONSUMER RIGHTS

Nothing in these Terms affects the rights you have under Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including the right of withdrawal and the right to a product that conforms to its description.

 

SECTION 17 — INDEMNIFICATION

You agree to indemnify and hold harmless Purdice Jewellery, Shopify and our affiliates, officers, employees and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third-party right, or misuse of the website.

 

SECTION 18 — SEVERABILITY

If any provision of these Terms is found unlawful, void or unenforceable, it will be enforced to the fullest extent permitted and severed where it cannot be, without affecting the validity of the remaining provisions.

 

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any right or provision is not a waiver of it. These Terms and any policies posted on this site constitute the entire agreement between you and us, superseding any prior agreements or communications.

 

SECTION 20 — ASSIGNMENT

You may not transfer or assign these Terms or your rights under them without our written consent. We may transfer or assign them without notice to you.

 

SECTION 21 — GOVERNING LAW

These Terms are governed by the law of England and Wales, and disputes fall under the courts of England and Wales without affecting your right to bring a claim in the country where you live.

You can review the current version of these Terms on this page at any time. We may update or replace any part of them by posting changes to our website. We will notify you of material changes as required by law. Continued use of the Services after changes are posted constitutes acceptance. Changes made to these terms should not affect accepted orders.
